Assumed to be more than 100 years old, hence public domain
This is a faithful photographic reproduction of a two-dimensional, public domain work of art. The work of art itself is in the public domain in its source country for the following reason:
Public domainPublic domainfalsefalse
The copyright situation of this work is theoretically uncertain, because in the country of origin copyright lasts 70 years after the death of the author, and the date of the author's death is unknown. However, the date of creation of the work was over 120 years ago, and it is thus a reasonable assumption that the copyright has expired (see here for the community discussion). Do not use this template if the date of death of the author is known.

The official position taken by the Wikimedia Foundation is that "faithful reproductions of two-dimensional public domain works of art are public domain". This photographic reproduction is therefore also considered to be in the public domain in the United States. In other jurisdictions, re-use of this content may be restricted; see Reuse of PD-Art photographs for details.
This closeup head is part of a full portrait in uniform listed in the Getty Hulton picture library 3069517 by G. West and son, with a stated publication date of 1 jan 1870 [2][dead link]. It appears in a number of other version available on the internet, and is published in 'Dreadnought' by Robert K. Massie, 1991, random house, where the caption states it shows Fisher as captain of HMS Excellent in 1883. G west and son consisted of George West and his son, Alfred West (1857-1937)[3]. G. West operated in Gosport, Fisher spending much of his naval career at the nearby portsmouth navy base. Assuming it to be the work of the son, then copyright life plus 70 years is expired.
